Purchaser(s) agrees to pay to the Contractor the reasonable cost of enforcement or collection, and/or if in the event it is necessary for the Contractor to retain an attorney and/or to institute legal proceedings. Purchaser agrees to pay reasonable attorney’s fees and costs incurred, whether or not court proceedings are instigated, in addition to other sums.
ADVANCED WINDOW SYSTEMS, INC. AUTHORIZED SERVICES WARRANTY:
In addition to any warranty extended to you on the product(s) used in a service, should the workmanship (or application) fail, Advanced Window Systems, Inc., will, upon notice from you, cause such faults to be corrected by repair at no additional cost to you. (Two-year limitation on caulking)
Service under warranty is available by calling (231) 935-3700. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
INSTALLATION. It is understood that Contractor may not install said materials but that by your signature you authorize Contractor to arrange for the performance of the installation by a qualified installer. You also authorize Contractor (1) to issue an installation work order with the specifications shown herein and (2) to pay the installer upon your execution of a completion certificate establishing that the installation has been satisfactorily completed. You agree to pay to Contractor the amount specified herein, which will cover the prices of said materials and the installation charge.
ALL WORKMEN COVERED BY COMPENSATION AND PUBLIC LIABILITY INSURANCE.
Seller agrees to repair damage that is done by the seller’s workmen when replacing or installing windows (as close to the original condition as possible). Owners acknowledge that replacement material may not match exactly the existing material on the home or building.
That a residential builder or a residential maintenance and alteration contractor is requires to be licensed under article 245 of Act No. 299 of the Public Acts of 1980, amended, being sections 339.241 – 339.241 of the Michigan Compiled Laws. That a plumber is required to be licensed under Act No. 266 of the Public Acts of 1929, as amended, being sections 338.901 – 338.917 of the Michigan Compiled Laws. That Advanced Window Systems, Inc., is a licensed residential builder, License No. 2101210957.
Any surplus material remaining after completion of the job shall remain the property of the contractor. No credit is due on returns.
There shall be no liability for delays in, or failure to complete delivery or installation of all or any of the herein mentioned merchandise, if due to any cause beyond Contractors control, including but not limited to fire, strikes, war, governmental regulations, labor or material shortages.
There is no warranty expressed or implied on glass condensation. If such moisture should occur on the glass, it would indicate excess humidity, not a window problem. Since the new windows will be more airtight than the old window, more moisture will be retained in the home. Therefore, you should reduce your humidity if condensation occurs.
Due to their value and delicate nature, our installers DO NOT remove or re-install shades, shutters, blinds and drapes. (Note, you may need to re-size window treatments due to opening modifications resulting from the new window installation.)
Gutters are meant to divert water. A small amount of water escaping is normal operation of gutters.
This Contract and the agreement for finance, if any, shall constitute the entire agreement between the parties, which entire agreement and specifications shall not be altered or modified except by written agreement between the parties hereto.
1.5% service charge on 30 days past due accounts, 18% annual.
IN THE EVENT THE OFFER TO CONTRACT IS NOT ACCEPTED BY THE CONTRACTOR, ANY PAYMENT MADE HEREUNDER SHALL BE REFUNDED TO THE PURCHASER(S) AND THIS PROPOSAL SHALL BE NULL AND VOID AND OF NOT EFFECT. CONTRACTOR IS NOT RESPONSIBLE FOR EXISTING STRUCTURAL DEFFECTS, DRY ROT OR CODE VIOLATIONS, NO REPAIRING, PLASTERING, PAINTING, STAINING, CARPENTRY OR DECORATING IS INCLUDED UNLESS SPECIFICALLY CHARGED FOR AND SPECIFIED IN WRITING HREIN.
NOTICE OF CANCELLATION
You may cancel this transaction, without any penalty or obligation, within 3 business days from the above date.
If you cancel, any property traded in, any payments made by you under the contract or sale, and any negotiable instrument executed by you will be returned within 10 business days following receipt by the seller of your cancellation notice, and any security interest arising out of the transaction will be cancelled.
If you cancel, you must make available to the seller at your residence, in substantially as good condition as when received, any goods delivered to you under this contract or sale; or you may if you wish, comply with the instructions of the seller regarding the return shipment of the goods at the seller’s expense and risk.
If you do make the goods available to the seller and the seller does not pick them up within 20 days of the date of your notice of cancellation, you may retain or dispose of the goods without any further obligation. If you fail to make the goods available to the seller or if you agree to return the goods to the seller and fail to do so, then you remain liable for performance of all obligation under the contract.
